Understanding the time limits to file a workers’ comp claim
According to the Virginia Workers’ Compensation Commission, those injured at work who want to receive workers’ comp benefits have to report their work-related injury or illness to their employer within 30 days. However, it is smart to report your injury to your employer as soon as possible.
Additionally, if you decide to file a workers’ compensation claim, you must do so within two years from the day of the accident. If you fail to report your accident to your employer or file a claim within this timeframe, the Commission could deny your claim.
Other requirements to secure workers’ comp benefits
In addition to reporting your injury and filing your clam in a timely manner, you must provide the commission with your current address and report a change of address if you move.
In order to file a claim, you need to fill out a Claim for Benefits Form, which you can submit online, in person, via fax or through the mail. If they deny your claim, look into the possibility of appealing the decision.
